INVOLVING
On the one hand, and acting on their own behalf, the USER, with address and ID supplied by the user and included in the database of a file which is responsible Pernod Ricard Winemakers Spain, in compliance with Organic Law 15/1999 of December 13, Protection of Personal Data, hereinafter, the Purchaser.
And on the other hand, Pernod Ricard Winemakers Spain, with VAT number A-11606118 and legal address at Miramon, Paseo Mikeletegi 71, 2nd floor, 20009 Technology Park - San Sebastian (Gipuzkoa), Spain, hereinafter, Pernod Ricard Winemakers Spain.
Both parties, mutually recognize the capacity to enter into this contract in accordance the following
GENERAL TERMS AND CONDITIONS
1. The Agreement: These Terms and Conditions shall apply to all products offered by Pernod Ricard Winemakers Spain, as well as the supply of goods or services marketed by Pernod Ricard Winemakers Spain in the "Web for online management of the visits" http://visitas.pernodricardbodegas.com. These Terms shall remain in force for all goods and services that are offered and can be modified without notice and does not affect changes to the purchases already made so far.
2. Purchase Formalization: the purchase of products offered on the website is done by selecting the chosen products, which will be included in the shopping cart. After the selection, the user will continue the purchase proceeding with the completion of the personal data (depending on each case) for issuing of the invoice and credit card data for the payment of the goods. Finally accepting the purchase made, it will make the definitive purchase of the selected products and proceed to select the method of payment (credit card).
3. Intellectual Property: Pernod Ricard Winemakers Spain authorizes the use of their trademarks in the agreed terms in these Terms and Conditions. In no case, it is understood that any license is granted or is done any resignation, transfer, or cession total or partial of such rights, or any right or expectation of rights conferred, in particular, alteration, exploitation, reproduction, distribution or public communication about these contents without the express permission of Pernod Ricard Winemakers Spain.
In the event that the Buyer/User becomes aware of unauthorized third party, as soon as possible, he/she will inform Pernod Ricard Winemakers Spain to be able to take measures if deemed appropriate.
4. Applicable Law and Jurisdiction: This Agreement and all documents annexed thereto shall be governed by and construed in accordance with Spanish law. In case of divergence between the parties concerning this Agreement, the parties agree, waiving their own jurisdiction if they had, to expressly submit to the jurisdiction of the Courts of San Sebastian (Gipuzkoa), Spain.
